TONIGHT IN A STORY YOU'LL ONLY SEE ON 40/29, A MAN WHO WAS SHOT TWICE JUST A FEW WEEKS AGO BY AN OFF DUTY DEPUTY IS TALKING ABOUT HIS INJURIES AND WHAT HE HOPES HAPPENS NEXT. 40/29'S BRETT RAINS IS LIVE TONIGHT IN FAYETTEVILLE WITH THE EXCLUSIVE INTERVIEW. ADAIR COUNTY DEPUTY TRAVIS ADAMS WAS RELEASED FROM THE WASHINGTON COUNTY DETENTION CENTER ON SATURDAY. HE WAS ISSUED A 50- THOUSAND DOLLAR BOND. HE'S ACCUSED OF SHOOTING JUSTIN HELLYER. (BACK ON CAM FOR BRETT) SOME OF WHAT HAPPENED WAS CAUGHT ON VIDEO. WE'RE NOT SHOWING THE MOMENT HELLYER WAS SHOT. <> "I hate that he shot me and it hurts. And every day that goes by, know what I'm saying, it's constant pain and constant ache." JUSTIN HELLYER IS BACK HOME AFTER HE WAS SHOT IN THE STOMACH AND HIP THREE WEEKS AGO. HE'S HAD MULTIPLE SURGERIES AND FACES MORE IN THE FUTURE, AND HE SAYS DOCTORS TOLD HIM THEY COULD NOT REMOVE ONE BULLET THAT'S LODGED IN HIS TAIL BONE. <> "they'd say it's something's gonna be there the rest of my life. They said that it probably paralyzed me if they removed it. So they said they're just gonna leave it in there." "it could of of killed me very easily." ON SEPTEMBER 3RD, HELLYER WAS CHECKING ON HIS FAMILY OWNED PROPERTY IN LINCOLN WHEN HE SAW TRAVIS ADAMS, WHO LIVES THERE. <> "He gets about 20 foot from my vehicle, I roll my window down, he sees me and turns around running back towards the house saying get my gun. He comes out with it and he shoots once up in the air. He shoots once in front of my vehicle, and then I open my door and shoots one shot by my, right by my vehicle like right by the door." BUT HELLYER DID NOT LEAVE. <> "I'd rather be I'd rather be coming at it and than running from it you know." "I had no intentions of causing any harm or doing anything to him." HE SAYS HE AND ADAMS ARE ACTUALLY RELATED BUT NOT BY BLOOD. ADAMS IS A DEPUTY IN TRAINING FOR THE ADAIR COUNTY SHERIFFS DEPARTMENT WHO WAS OFF DUTY WHEN THE SHOOTING HAPPENED. CELL PHONE VIDEO TAKEN BY HELLYER'S FRIEND SHOWS THE TWO MEN ARGUING AND PUSHING EACH OTHER. ADAMS WAS ARMED WITH HIS COUNTY ISSUED GUN... ACCORDING TO COURT DOCUMENTS. HELLYER WAS UNARMED. THE VIDEO SHOWS HELLYER GRABBING ADAMS. THAT'S WHEN ADAMS SHOOTS HIM TWICE. <> "that's when everything calmed down." AFTER REVIEWING THE CASE FILE, THE WASHINGTON COUNTY PROSECUTOR CHARGED ADAMS WITH AGGRAVATED ASSAULT AND FIRST DEGREE BATTERY, BOTH ARE FELONIES. HELLYER SAYS HE WISHES BOTH MEN HANDLED THINGS DIFFERENTLY THAT DAY. <> "You know, I don't want to see him charged. You know what I'm saying, I really don't want to see him get his whole life ruined. You know, because he was like family, you know, despite our differences, you know, I'm saying I have nothing against him as an individual." THE ADAIR COUNTY SHERIFF SAYS HE BELIEVES ADAMS WAS DEFENDING HIMSELF. THE SHERIFF TOLD US MONDAY THAT ADAMS IS BACK IN TRAINING TO BE A FULL TIME DEPUTY. <> "I don't feel like we need cops out there that's just willing to just just shoot anybody, you know, but I don't think he's he would just shoot anybody though, you know, (Brett asks "just you?") Well, I feel like it was because of the situation." "I kind of feel like I brought it on myself you know due to my choices. You know what I'm saying, from from leading up to it, but at the same time, you know, it's not right. It's not right that he shot me, you know what I'm saying, it's not right at all." WE'VE TRIED CONTACTING ADAMS, SO FAR HE'S NOT GOTTEN BACK WITH US. HIS NEXT COURT DATE HAS NOT YET BEEN SET

A man who was shot twice by an off-duty deputy is talking about his injuries.Justin Hellyer has had multiple surgeries and will likely have more in the future. Doctors told him they could not remove a bullet that is lodged in his tailbone."They'd say it's something's gonna be there the rest of my life," Hellyer said. "They said that it probably paralyzed me if they removed it." Travis Adams, a deputy-in-training in Adair County, was arrested on an aggravated assault and a battery charge and released on a $50,000 bond.Adams has not been suspended and is continuing his training.
